Refusal of a “Talent Passport” residence permit: understanding the silence of the administration

After submitting an application for a “Talent Passport” residence permit on the ANEF platform, a review phase begins, the outcome of which can sometimes seem uncertain. While some applications are processed quickly, others remain unanswered for several months.

In French administrative law, this silence is never neutral. It has specific legal effects that it is essential to understand in order to protect your rights.

1. General principle: silence on the part of the administration is equivalent to a refusal after four months
For most categories covered by the “Talent Passport” (skilled employees, entrepreneurs, investors, artists, people of national or international renown, etc.), the rule is as follows: if the prefecture does not respond within four months, this is equivalent to an implicit decision of refusal.
In other words, when 120 days have passed without written notification from the administration, the application is legally deemed to have been rejected, even in the absence of a letter or message on the platform.

2. Important exceptions: shorter deadlines depending on the profile
Certain categories of “Talent Passport” are subject to specific, shorter deadlines, which must be monitored with particular vigilance.

  • Talent Passport – European Blue Card: Silence from the administration is considered a refusal after 90 days. This deadline is reduced to 30 days when the applicant already holds a European Blue Card issued by another European Union member state.
  • Talent Passport – Researcher: Implicit refusal occurs after 60 days without a response from the prefecture. In these situations, waiting for the four-month period to expire would be a strategic error, likely to result in the loss of precious time for the exercise of remedies.

3. Explicit refusal and the risk of OQTF
In addition to implicit refusal, the administration may also issue an explicit refusal, in the form of a written and reasoned decision by the prefect.
In most cases, this refusal decision is accompanied by an obligation to leave French territory (OQTF), which sets a departure deadline and designates the country of return. This situation requires greater responsiveness, given the legal and personal consequences attached to the OQTF.

4. Remedies available to the applicant
Whether the refusal is implicit or explicit, the applicant has two months to challenge the decision.
This period runs:

  • either from the date of notification of the written refusal,
  • or from the expiry of the period at the end of which silence is deemed to constitute rejection.

Two types of appeal are then possible:

Administrative appeals:

  • informal appeal to the prefect who made the decision,
  • and/or hierarchical appeal to the Minister of the Interior.

Contentious appeal:
Referral to the competent administrative court to challenge the legality of the refusal and, where applicable, the OQTF.

Choose between Talent Passport – Skilled Employee and Employee Residence Permit

1. Target audience

Talent Passport – Skilled Employee: mainly applies to employees on assignment (intra-group mobility) and innovative start-up profiles. The employee must provide proof of a contract (permanent or fixed-term ≥ 3 months) and a salary that meets the required thresholds.

Employee/temporary worker residence permit: issued under a permanent contract (marked “employee”) or fixed-term contract (marked “temporary worker”) for foreign nationals with a prior work permit, regardless of their level of qualification.

2. Length of stay & renewal

Talent Passport: valid for 1 to 4 years, renewable. Once obtained, the person concerned may change employer or suspend their contract without losing their status (France-Visas).

Employee permit: temporary one-year card, renewable, with the possibility of upgrading to a multi-year card (up to 4 years) under certain conditions, particularly for permanent contracts.

3. Authorization and formalities

Talent Passport: if the criteria are met, total exemption from work authorization. Online application via Anef, followed by an application for a multi-year residence permit in France.

Employee/temporary worker permit: work authorization required in advance via the employer. A new permit must be obtained for each new contract or change of employer.

4. Family law

Talent Passport: immediate family arrival, no seniority requirement; the spouse may engage in salaried employment as soon as the permit is obtained.

Employee permit: the spouse is eligible for family reunification after 18 months of legal residence in France, with work rights subject to conditions (permit, etc.).

5. Flexibility & professional mobility

Talent Passport: easy change of employer, no need for a new permit as long as the criteria are met.

Employee permit: any change of employer or position requires a new work permit, even for permanent contracts

6. Financial and salary constraints

Talent Passport: comply with the required salary thresholds (via a qualified assignment or start-up). The expense depends on the category (assignments or innovative talents). No employer tax.

Employee status: obligation to comply with the salary stated in the initial work permit. The employer pays a tax (≈ 55% of the minimum wage) for each application
