A family reunification refusal is never the end of the road. Depending on who refused and at what stage, different appeals are available, with strict deadlines.
Two types of refusal
- Refusal by the prefect of the family reunification application itself, usually for insufficient resources, unsuitable housing, unclear family ties or an irregular situation of the applicant. The decision must be reasoned.
- Refusal of the visa by the French consulate, after the prefect’s approval, usually on civil status grounds. See: Visa refusal for family reunification.
Implicit refusal: watch the six-month deadline
The prefect must notify the decision within six months of the complete filing with the OFII. If there is no answer after six months, the application is implicitly refused. Many applicants are unaware of this rule and lose valuable time.
Our advice: send a registered letter asking for the reasons for the implicit refusal. The administration must communicate them, and the time limit for bringing a court action is extended until one month after the reasons are communicated.
Appeals against the prefect’s refusal
Administrative appeal (gracious or hierarchical)
- Gracious appeal to the prefect, or hierarchical appeal to the Minister of the Interior;
- within two months of the decision;
- by reasoned letter, with any new supporting documents (for example, updated payslips or a new lease).
An administrative appeal filed within the time limit extends the deadline for going to court.
Court action
- before the administrative court with territorial jurisdiction;
- within two months of the decision, or of the rejection of the administrative appeal;
- aimed at annulling the refusal and obtaining an injunction for the application to be re-examined or granted.
Appeals against the consulate’s visa refusal
- mandatory prior appeal to the Commission de recours contre les refus de visa (CRRV) within 30 days;
- then action before the Administrative Court of Nantes;
- in urgent cases, a référé-suspension.
Documents to provide
- a full copy of the contested decision;
- proof of resources (payslips, contracts, tax notices);
- lease or deed of ownership;
- civil status records (birth, marriage) with sworn translations;
- any proof of real and stable family ties (photos, exchanges, transfers, visits).
Precautions
- Deadlines are crucial: missing one makes the refusal final.
- Check the procedure: a procedural flaw can lead to annulment.
- Fix the weak point: if the refusal concerns resources or housing, it is sometimes more effective to correct the situation and file a new application while challenging the refusal.
