If the hiring date has passed on the day of the application, the request is automatically non-compliant.

Anticipate delays and regularly adjust the provisional start date on the ANEF platform so that it remains after the application date.

3. Increased monitoring of subcontracting and service provision
Since September 2024, the authorities have been conducting thorough checks on the economic reality of recruitment, particularly when the employer is a service provider (agricultural or wine-growing companies, etc.).

Reason for refusal
The administration has required the production of the service contract between the employer and the end customer, with very detailed information:

  • area of the plots,
  • precise work schedule,
  • price of the service (flat rate or per task),
  • SIRET numbers of the companies concerned.

Legal basis
This check is based on Article R.5221-20-1 of the Labor Code, which allows authorization to be refused if the recruitment is deemed to be clearly disproportionate to the actual activity of the company.

Practical advice
When submitting your application, include signed commercial contracts that are detailed and consistent with the volume of labor requested.

4. Seasonal worker housing: an essential requirement
For foreign seasonal workers, the issue of housing is an essential prerequisite.

Reason for refusal
The application was blocked due to the lack of proof of decent housing.

Applicable rule
The employer must demonstrate that the employee will have access to housing conditions that are consistent with human dignity for the entire duration of the contract.

Be aware of deadlines
If additional documents are requested, the administration allows a maximum of 14 days. After this period, the application is automatically closed without further review.
